Public Notice: Public Consultation Meeting - Redevelopment of Cavendish Mall

TO ALL PERSONS INTERESTED IN THE FIRST DRAFT BY-LAW NUMBERED 2217-MM-P1 AND ENTITLED:

“By-law to amend the zoning by-law No. 2217 of the City of Côte Saint-Luc in order to delete the actual boundaries of zone “CC-2” and to modify the actual boundaries of zones “CC-3” and “PM-25” in order to create the following new zones: “RU*-64”, “RU*-65”,  “RU*-66”, “RU-67”, “RU-68”,  “RU-69”, “RM*-62”, “HM-6”,  “PM-37”, “PM-38” and “PM-39” ”

PUBLIC NOTICE is hereby given by the Undersigned, Me Jonathan Shecter, Director of Legal Services and City Clerk, that following the adoption by Resolution of the above-mentioned first draft by-law at a Special Council meeting held on May 17, 2010  the Council of the City of Côte Saint-Luc will hold a public consultation meeting on Monday, June 14, 2010 at 7:30 P.M. at the City Hall situated at 5801 Cavendish Boulevard, in accordance with the Provisions of the Act respecting land use, planning and development.

The object of the meeting is to discuss the proposed by-law which seeks in particular, to reduce the area of the zone “CC-3” in order to allow - on the portion of land excluded from zone CC-3 and forming new zones - a residential development with a mixed-use component. The reduced area of zone “CC-3” will remain devoted to commercial uses. It is of the essence of the by-law to be adopted that the development mostly provides for single-family dwellings units, attached and detached. The mixed-use component of the development shall be limited to very few constructions in order not to impact the single-family dwelling orientation of the development and the by-law. Consequently, the proposed by-law will delete the actual boundaries of Zone CC-2 as well as modify the boundaries of Zone CC-3 and PM-25 and replace said modified boundaries with the creation of new zones.

The following is a description of the modifications to the zoning by-law 2217, in particular, the relevant articles in the first draft of the by-law describing the variation from the current provisions of by-law 2217:

Art. 1.    Deletes the column of uses and norms for Zone CC-2 and creates the column of uses and norms for zone CC-3.
Art. 2.    Creates new columns of uses and norms for zones “RU*-64”, “RU*-65”, “RU*-66”, “RU-67”, “RU-68”, “RU-69”.
Art. 3.    Creates a new column of uses and norms for RM*-62.
Art. 4.    Creates a new column of uses and norms entitled ‘’HM-6’’.
Art. 5.    Creates a new column of uses and norms for zones “PM-37”, “PM-38” and  “PM-39’’.
Art. 6.    Deletes the Actual boundaries of Zone CC-2 and creates new boundaries for all of the new zones.
Art. 7.    Deals with the by-law coming into force.

A sketch of the concerned zones as well as the contiguous zones is annexed herewith to form an integral part thereof, to avail herein as if quoted hereinafter at length.

At this Public Consultation meeting, the Mayor and/or another member of Council, will explain the first draft by-law and the consequences of its subsequent adoption and will hear the persons and bodies wishing to be heard.

The first draft by-law contains provisions making the by-law subject to approval by way of a referendum. A notice providing the information pertaining to the procedure applicable to the approval by way of a referendum will be given by the City following the adoption of the second draft by-law.

The first draft by-law is available, free of charge, for examination at the City archives, located at 5801 Cavendish Boulevard during regular working hours, said hours being Monday through Friday between 8:30 a.m. and 4:30 p.m.
