Public Notice: Register 2324-2335

HOLDING OF A REGISTER TO QUALIFIED VOTERS ENTITLED TO HAVE THEIR NAMES ENTERED ON THE REFERENDUM LIST FOR THE MUNICIPALITY OF CÔTE SAINT-LUC

PUBLIC NOTICE is hereby given that:

1.    At its Regular meeting of January 18, 2010, the City Council adopted loan by-laws numbered and entitled:

By-law 2324 authorizing a loan of $1,200,000 for the resurfacing of various roads and the replacement of various sidewalk sections;

By-law 2325 authorizing a loan of $200,000 for the purchase and installation of various traffic control devices;

By-law 2326 authorizing a loan of $70,000 for electrical installations for the building located at 7001 Mackle road;

By-law 2327 authorizing a loan of $150,000 for the renovation of the building envelope at City Hall located at 5801 Cavendish boulevard and the Eleanor London Côte Saint-Luc Public Library located at 5851 Cavendish boulevard;

By-law 2328 authorizing a loan of $80,000 for the purchase and installation of various signage;

By-law 2329 authorizing a loan of $75,000 for the installation of a sewer system at 7001 Mackle road;

By-law 2331 authorizing a loan of $35,000 for upgrades to the building and tennis courts situated at 8215 Guelph road;

By-law 2332 authorizing a loan of $30,000 for renovations and upgrades to the municipal gymnasium situated at 7500 Mackle;

By-law 2333 authorizing a loan of $1,280,000 for playground equipment and park facility upgrades within the city;

By-law 2334 authorizing a loan of $50,000 for playground equipment upgrades within the city;

By-law 2335 authorizing a loan of $50,000 for the purchase and planting of various trees within the city.

2.    The purposes of these by-laws are as follows:

•    To authorize a loan of $1,200,000 for by-law 2324;
•    To authorize a loan of $200,000 for by-law 2325;
•    To authorize a loan of $70,000 for by-law 2326;
•    To authorize a loan of $150,000 for by-law 2327;
•    To authorize a loan of $80,000 for by-law 2328;
•    To authorize a loan of $75,000 for by-law 2329;
•    To authorize a loan of $35,000 for by-law 2331;
•    To authorize a loan of $30,000 for by-law 2332;
•    To authorize a loan of $1,280,000 for by-law 2333;
•    To authorize a loan of $50,000 for by-law 2334;
•    To authorize a loan of $50,000 for by-law 2335.

3.    The terms of the loans are as follows:

•    15 years for loan by-law 2324;
•    15 years for loan by-law 2325;
•    10 years for loan by-law 2326;
•    15 years for loan by-law 2327;
•    15 years for loan by-law 2328;
•    15 years for loan by-law 2329;
•    5 years for loan by-law 2331;
•    5 years for loan by-law 2332;
•    20 years for loan by-law 2333;
•    5 years for loan by-law 2334;
•    5 years for loan by-law 2335.

4.    Each loan shall be charged to taxpayers on the whole territory of the Municipality of Côte Saint-Luc;

5.    The object of the loan by-laws are as follows:
•    For loan by-law 2324, the resurfacing of various roads and the replacement of various sidewalk sections;
•    For loan by-law 2325, the purchase and installation of various traffic control devices;
•    For loan by-law 2326,electrical installations for the building located at 7001 Mackle road;
•    For loan by-law 2327, the renovation of the building envelope at City Hall located at 5801 Cavendish boulevard and the Eleanor London Côte Saint-Luc Public Library located at 5851 Cavendish boulevard;
•    For loan by-law 2328, the purchase and installation of various signage;
•    For loan by-law 2329, the installation of a sewer system at 7001 Mackle road;
•    For loan by-law 2331, upgrades to the building and tennis courts situated at 8215 Guelph road;
•    For loan by-law 2332, renovations and upgrades to the municipal gymnasium situated at 7500 Mackle;
•    For loan by-law 2333, playground equipment and parks facility upgrades within the city;
•    For loan by-law 2334, playground equipment upgrades within the city;
•    For loan by-law 2335, the purchase and planting of various trees within the city;

6.    Qualified voters entitled to have their names entered on the referendum list for the Municipality of Côte Saint-Luc may apply to have the aforementioned by-law submitted to a referendum poll by entering their name, address and capacity, together with their signature, in a Register opened for that purpose;

7.    The Register for these by-laws will be open, uninterrupted, on Monday, February 8, 2010 between 9:00 a.m. and 7:00 p.m. in the office of the City Clerk located at, 5801 Cavendish Boulevard;

8.    The number of signatures needed to require that a referendum poll be held for each by-law is 567.  If this number is not reached, the by-laws will be deemed approved by the qualified voters;

9.    The by-law may be consulted at the City archives located at 5801 Cavendish Boulevard, second floor, Monday to Friday, between 8:30 a.m. and 4:30 p.m. AND during the register period mentioned in paragraph 7;

10.    The results of the registration process will be announced in the office of the City Clerk (where the Register is held), on Wednesday, February 8, 2010 at 7:30 p.m. or as soon as they are available.

TO BE CONSIDERED A QUALIFIED VOTER

A qualified voter is any person who enters into one of the following two categories on January 18, 2010 (and at the time he exercises his right):

(1)    Any individual (natural person) who:

•    is domiciled in the territory of Côte Saint-Luc;
•    has been domiciled for at least six (6) months in Quebec;
•    is of full age (18 years old);
•    a Canadian citizen;
•    not under curatorship;
•    is not disqualified to exercise their right to sign the Register pursuant to the provisions governing the Act Respecting Elections and Referendums in Municipalities (R.S.Q., chapter E-2.2).

(2)    Any individual (natural person) or a legal person domiciled or not domiciled in the municipality of Côte Saint-Luc (concerned sector) or whose head-office is or is not located there, who, for at least 12 months:

•    has owned an immovable or has occupied a business establishment within the territory of Côte Saint-Luc;
•    is not disqualified to exercise their right to sign the Register pursuant to the provisions governing the Act respecting elections and referendums in municipalities (R.S.Q., chapter E-2.2).

PARTICULAR MANNER AND CONDITIONS WHICH A QUALIFIED VOTER (OTHER THAN A NATURAL PERSON) EXCERCISES THEIR RIGHT TO VOTE:

(1)    A legal person who is a qualified voter exercises his rights through one of its members, administrators or employees designated for that purpose by resolution.

The designated person must also, on January 18, 2010 (and at the time he exercises his right):

•    be of legal age
•    be a Canadian citizen
•    not be under curatorship
•    not disqualified to exercise their right to sign the register pursuant to the provisions governing the Act Respecting Elections and Referendums in Municipalities (R.S.Q., chapter E-2.2).

(2)     The co-owners of an immovable who are qualified voters in the sector concerned designate from among themselves, by a power of attorney signed by the majority of them, a person who is not entitled to be entered on the referendum list in another capacity, in the following order of precedence:

1.    as a domiciled person
2.    as the sole owner of an immovable
3.    as the sole occupant of a business establishment.

(3)     The co-occupants of a business establishment who are qualified voters in the sector concerned designate from among themselves, by a power of attorney signed by the majority of them, a person who is not entitled to be entered on the referendum list in another capacity, in the following order of precedence:

1.    as a domiciled person
2.    as the sole owner of an immovable
3.    as the sole occupant of a business establishment
4.    as the undivided co-owner of an immovable.

(4)     Legal persons, co-owners and co-occupants must file their resolution or power of attorney when registering. The resolution or Power of Attorney takes effect on the date of receipt and remains valid until it is replaced.

INELIGIBILITY TO SIGN THE REGISTER TWICE

Except in the case of a person designated to represent a legal person, no one may exercise their right to sign the register in more than one capacity, pursuant to section 531 of the Act respecting elections and referendums in municipalities (R.S.Q., chapter E-2.2).

IDENTIFICATION REQUIRED

 
To sign the register you must establish your identity by presenting one of the following documents:

•    your health insurance card;
•    your driver’s licence; or
•    your Canadian passport.
